    NOTICE OF REVOCATION OF SITE SPECIFIC ALTERNATIVE CRITERIA FOR DISSOLVED OXYGEN IN THE FENHOLLOWAY RIVER, HENDERSON RIVER, AND ADJACENT COASTAL WATERS
    On November 25, 2013, the Department of Environmental Protection (Department) issued a final order revoking site specific alternative criteria (SSAC) for dissolved oxygen (DO) in the Fenholloway River, Henderson River, and adjacent coastal waters in Taylor County.  The SSAC was established by final order on July 14, 2010, in response to a petition from Buckeye Florida, L.P., to establish a DO SSAC pursuant to Rule 62-302.800(1) of the Florida Administrative Code, for a segment of the Lower Fenholloway River, the Henderson River, and adjacent coastal waters.  The SSAC was established to reflect site specific natural background conditions.
    During the most recent triennial review of state surface water quality standards, the Department revised its DO criteria for the entire state.  These revised DO criteria were formally approved by the U.S. Environmental Protection Agency on September 9, 2013.  Analysis of recent DO water quality data in the Fenholloway River and estuary indicates that the above referenced DO SSAC is no longer needed, because the areas covered by the SSAC meet the state’s new DO criteria for predominantly marine waters.
    A person whose substantial interests are affected by this final order may petition for an administrative proceeding (hearing) under section 120.569 and 120.57, Florida Statutes, in accordance with the full notice of rights language contained in the final order.  The petition must contain the information identified in the full notice of rights language contained in the final order and must be filed (received by the clerk) in the Department’s Office of General Counsel at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000 within 21 days of publication of this notice or within 21 days of receipt of the written notice, whichever occurs first.

    The Florida Department of Environmental Protection (FDEP) gives notice that it proposes to approve a No Further Action Proposal with Institutional Controls.  Perry Saw Mill, LLC, is seeking this order in reference to FDEP Facility FLD984206250, Gilman Building Products, 1509 South Byron Butler PKWY, Perry, FL 32349, and intends to restrict exposure to contamination by implementing a Restrictive Covenant that prohibit use of groundwater under the site for Drinking water or irrigation purposes.
