YOU ARE NOTIFIED that on March 27, 2025, the Florida Gaming Control Commission filed the above styled forfeiture action against the above-described property in the Circuit Court of the Third Judicial Circuit of Florida, in and for Taylor County, which was seized on February 11, 2025, pursuant to a criminal investigation for offenses occurring in Taylor County, Florida. An order finding probable cause was issued by the Court on March 25, 2025. A copy of the aforementioned Complaint and Order are on file at the Office of the Clerk of the Courts for Taylor County, Florida, and are available for examination during regular business hours.
YOU ARE REQUIRED to serve a copy of your written defenses, if any, to the Complaint and Order finding Probable Cause upon Marc Daniel Taupier, Deputy General Counsel and Chief Gaming Enforcement Legal Advisor for the Florida Gaming Control Commission, whose address is 4070 Esplanade Way, Suite 250, Tallahassee, Florida 32399, and file the Original with the Clerk of Court, Taylor County, Florida. Final Notice and Public Explanation of a Proposed Activity in the
100-Year Floodplain and Wetland

This is to give notice that the City of Perry, Florida has conducted an evaluation as required by Executive Orders 11988 and 11990 in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management to determine the potential effects that the activity in the floodplain will have on the environment. The activity is funded by the Florida Department of Commerce Community Development Block Grant (CDBG) program under Grant No. 25DB-E04.
The proposed activity will repave approximately 6,256 LF of roadways in Perry’s downtown business district. The project will resurface approximately 6,256 LF of Main Street and Green Street along with sidewalk and signage repairs as needed to direct potential shoppers to Perry’s downtown commercial area. The City will also repave up to an additional 9,041 LF on the following streets: Washington Street from Ellis Street to Lafayette Street; Faulkner Street from Drew Street to Leon Street; Orange Street from Ellis Street to Lafayette Street; and Quincy Street from Ellis Street to Lafayette Street. In addition, the project will include the resurfacing of four parking lots that provide parking for the general public. A final proposed project activity will be facade improvements to approximately thirty-five buildings in the commercial downtown area. This area is bounded by Wilcox, Faulkner, Center, and Ellis streets. Portions of the roadways and parking areas to be repaved, along with the building facade improvement area, are mapped by FEMA as being affected by the 100-year floodplain. The maximum total area that could be affected by these proposed activities is 6.01 acres. The proposed project is intended to benefit the downtown commercial district of the City of Perry which is located in Taylor County, Florida.
The City has carefully evaluated project alternatives and mitigation strategies to minimize adverse impacts to the floodplain and to preserve its natural and beneficial functions. Due to the linear nature of the paving work, excluding flood-prone segments would result in fragmented, inconsistent pavement coverage. Such an approach would neither serve the public interest nor prevent further deterioration of the aging roadway system. Prolonged neglect of these sections may accelerate subgrade erosion, pothole formation, and eventual road failure. Considered alternatives included omitting resurfacing on blocks intersecting the mapped floodplain, removing floodplain-impacted streets from the work scope, or forgoing resurfacing altogether. The first would produce only marginal benefit over the patchwork scenario and still leave key downtown corridors vulnerable to degradation. The latter two options would undermine the project’s principal goal of enhancing the visual character and economic viability of Perry’s commercial district. To offset any loss of floodplain storage in resurfaced areas, milling operations are proposed as a compensatory mitigation measure. That is, several roadways within the project impact area have been overlain with multiple layers of asphalt over time, which has diminished both floodplain storage capacity and the ability of roadside curbs to convey stormwater effectively. To address this, milling will be performed to restore the pavement elevation to its original design gradient, allowing new asphalt to be placed without further disrupting hydrologic function. This approach is expected to improve both stormwater conveyance and floodplain volume. Standard erosion control measures typical of urban repaving and resurfacing operations will be incorporated into the project’s detailed specifications. Regarding the proposed storefront façade improvements, no impact on the flood zone is anticipated because the improvements will be limited to repainting or resurfacing the vertical surfaces of storefronts.
A description of the proposed project has been forwarded to the Suwannee River Water Management District, the pertinent Indian Tribes of Florida, the Taylor County Historical Society, the Florida Bureau of Historic Preservation, and other interested agencies for review. Comments from these agencies and organizations will be considered and included in the project’s environmental review record
The City of Perry has re-evaluated the alternatives to building in the floodplain and has determined that it has no practicable alternative due to the scope of the project. The City has also determined that the project is vital to the nourishment of the City’s downtown commercial area. The elimination of paving certain areas by the patchwork method described above or the elimination of certain blocks will defeat the intent of creating an inviting and updated commercial district. Milling previously over paved areas will have the desired mitigating effect of restoring damaged pavement and restoring floodplain capacity to Perry’s downtown area. Environmental files that document compliance with steps 3 through 6 of Executive Order 11988 are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice.
There are three primary purposes for this notice. First, people who may be affected by activities in floodplains and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comments about floodplains can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains, it must inform those who may be put at greater or continued risk.
