    Public Notice of Intent to Issue Air Permit

    Applicant: The applicant for this project is Foley Cellulose LLC. The applicant’s authorized representative and mailing address is: Lee Davis, Vice President—General Manager, Foley Cellulose LLC, Foley Mill, 1 Buckeye Drive, Perry, Florida 32348.
    Facility Location: Foley Cellulose LLC operates the existing Foley Mill, which is in Taylor County at 1 Buckeye Drive in Perry, Florida.
    Project: The applicant proposes to redefine the capacities of the two bark boilers in terms of steam output, rather than fuel input. The applicant also proposes to replace the superheater section of the No. 1 Bark Boiler, and to reconfigure the pre-scrubber that aids in the control of emissions of sulfur-containing compounds. The project is expected to have a minimal impact on air emissions from the facility.
    Permitting Authority: Applications for air construction permits are subject to review in accordance with the provisions of Chapter 403, Florida Statutes (F.S.) and Chapters 62-4, 62-210 and 62-212 of the Florida Administrative Code (F.A.C.). The proposed project is not exempt from air permitting requirements and an air permit is required to perform the proposed work. The Permitting Authority responsible for making a permit determination for this project is the Office of Permitting and Compliance in the Department of Environmental Protection’s Division of Air Resource Management.     Notice of Intent to Issue Air Permit: The Permitting Authority gives notice of its intent to issue an air construction permit to the applicant for the project described above. The applicant has provided reasonable assurance that operation of proposed equipment will not adversely impact air quality and that the project will comply with all applicable provisions of Chapters 62-4, 62-204, 62-210, 62-212, 62-296 and 62-297, F.A.C. The Permitting Authority will issue a Final Permit in accordance with the conditions of the proposed Draft Permit unless a timely petition for an administrative hearing is filed under Sections 120.569 and 120.57, F.S. or unless public comment received in accordance with this notice results in a different decision or a significant change of terms or conditions.
    Comments: The Permitting Authority will accept written comments concerning the proposed Draft Permit for a period of 14 days from the date of publication of the Public Notice. Written comments must be received by the Permitting Authority by close of business (5:00 p.m.) on or before the end of this 14-day period. If written comments received result in a significant change to the Draft Permit, the Permitting Authority shall revise the Draft Permit and require, if applicable, another Public Notice. All comments filed will be made available for public inspection.
    Petitions: A person whose substantial interests are affected by the proposed permitting decision may petition for an administrative hearing in accordance with Sections 120.569 and 120.57, F.S. Petitions filed by any persons other than those entitled to written notice under Section 120.60(3), F.S., must be filed within 14 days of publication of the Public Notice or receipt of a written notice, whichever occurs first. Under Section 120.60(3), F.S., however, any person who asked the Permitting Authority for notice of agency action may file a petition within 14 days of receipt of that notice, regardless of the date of publication. A petitioner shall mail a copy of the petition to the applicant at the address indicated above, at the time of filing. A petition for administrative hearing must contain the information set forth below and must be filed (received) with the Agency Clerk in the Office of General Counsel, 3900 Commonwealth Boulevard, MS 35, Tallahassee, Florida 32399-3000, Agency_Clerk@dep.state.fl.us, before the deadline. The failure of any person to file a petition within the appropriate time period shall constitute a waiver of that person’s right to request an administrative determination (hearing) under Sections 120.569 and 120.57, F.S., or to intervene in this proceeding and participate as a party to it. Any subsequent intervention (in a proceeding initiated by another party) will be only at the approval of the presiding officer upon the filing of a motion in compliance with Rule 28-106.205, F.A.C.
    A petition that disputes the material facts on which the Permitting Authority’s action is based must contain the following information: (a) The name and address of each agency affected and each agency’s file or identification number, if known; (b) The name, address, any email address, telephone number and any facsimile number of the petitioner; the name, address any email address, telephone number, and any facsimile number of the petitioner’s representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioner’s substantial interests will be affected by the agency determination; (c) A statement of when and how each petitioner received notice of the agency action or proposed decision; (d) A statement of all disputed issues of material fact. If there are none, the petition must so state; (e) A concise statement of the ultimate facts alleged, including the specific facts the petitioner contends warrant reversal or modification of the agency’s proposed action; (f) A statement of the specific rules or statutes the petitioner contends require reversal or modification of the agency’s proposed action including an explanation of how the alleged facts relate to the specific rules or statutes; and, (g) A statement of the relief sought by the petitioner, stating precisely the action the petitioner wishes the agency to take with respect to the agency’s proposed action. A petition that does not dispute the material facts upon which the Permitting Authority’s action is based shall state that no such facts are in dispute and otherwise shall contain the same information as set forth above, as required by Rule 28-106.301, F.A.C.
    Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means that the Permitting Authority’s final action may be different from the position taken by it in this Public Notice of Intent to Issue Air Permit. Persons whose substantial interests will be affected by any such final decision of the Permitting Authority on the application have the right to petition to become a party to the proceeding, in accordance with the requirements set forth above.

    Applicant: The applicant for this project is West Fraser, Inc. The applicant’s authorized representative and mailing address are: Mr. Cullen Adair, Manager, Perry Mill, West Fraser, Inc., 9150 Curry Ford Road, Perry, Florida 32348.
    Facility Location: This existing facility is in Taylor County at 1509 South Byron Butler Parkway, Perry.
    Project: The applicant applied on March 14, 2018, to the Department for a minor source air construction (AC) permit.
    The existing facility is a “Chip-n-Saw” Mill that consists of several pieces of equipment used to process southern yellow pine logs into chips, bark, and graded lumber. Equipment currently includes two direct-fired kilns, two baghouses for the fuel systems, a log debarker, saw, chipper, sorter, planer, cyclones, and a hammer mill. Southern pine logs arrive by truck and are unloaded in a log storage area prior to debarking. Debarked logs are sawed and then dried on site in the kilns. Wood wastes are fed from the saw mill into the direct-fired kilns via silos and conveyors. The dried lumber is then planed, trimmed, and graded prior to shipment. Also at the facility are miscellaneous unregulated and insignificant emission units and/or activities. The existing facility is currently operating under Title V air operation Permit No. 1230033-013-AV.
    The minor source AC permit is for the construction of a new 120 million board feet per year (MMBF/year) direct-fired continuous lumber drying kiln at this existing facility. Once this kiln is operational, the existing direct-fired lumber drying Kiln No. 3 which is permitted at 60 MMBF/year will be retired. In addition, the recently permitted direct-fired batch lumber drying Kiln No. 5 rated at 90 MMBF/year (emission unit 009 whose construction was authorized under Permit No. 1230033-014-AC) will not be constructed and that air construction (AC) permit will be surrendered upon issuance of this AC permit. The facility’s new permitted capacity after this project will be 210 MMBF/year.
    Previously, this existing facility was classified as an existing major stationary source in accordance with Rule 62-212.400, F.A.C. for the Prevention of Significant Deterioration (PSD) of Air Quality and Rule 62-210.200 (Definitions), F.A.C. However, as discussed in the Technical Evaluation and Preliminary Determination document included in this draft permit package, this facility is currently not a PSD major source based on historical emissions. However, because of this project, the facility will henceforth be considered a major stationary source in accordance with Rule 62-212.400, PSD. Details of the project are provided in the application and in the Technical Evaluation & Preliminary Determination document that is included in the draft permit package.

    Comments: The Permitting Authority will accept written comments concerning the draft air construction permit for a period of 14 days from the date of publication of the Public Notice. Written comments must be received by the Permitting Authority by close of business (5:00 p.m.) on or before the end of this 14-day period. If written comments received result in a significant change to the draft air construction permit, the Permitting Authority shall revise the draft air construction permit and require, if applicable, another Public Notice.     NOTICE OF REQUEST FOR BIDS
    THE SALE AND CUTTING OF PLANTED PINES AND TIMBER AT PERRY-FOLEY AIRPORT, PERRY, FLORIDA
    The Taylor County Board of County Commissioners is soliciting bids for THE SALE AND CUTTING OF PLANTED PINES AND TIMBER AT PERRY – FOLEY AIRPORT, PERRY FLORIDA. Bids will be received for the sale and cutting of 36.5 acres of mature planted pines. There are three bid alternates outlined in the Scope of Work which include the cutting of approximately 58 additional acres of non-mature pines and miscellaneous timber, and the conversion of the parcels in which the timber will be cut to grassland. The proceeds from the sale of timber will be dedicated to capital improvement project(s) at Perry-Foley Airport as approved by the County, the Federal Aviation Administration (FAA), and the Florida Department of Transportation (FDOT) Aviation Division.
    Qualified firms or individuals desiring to provide the requested services must submit their bid package in a sealed envelope or similar sealed package marked “Sealed bids for ‘THE SALE AND CUTTING OF PLANTED PINES AND TIMBER AT PERRY – FOLEY AIRPORT, PERRY FLORIDA.’ ” to the Clerk of Court, 1st Floor Courthouse, 108 North Jefferson Street, Perry, Florida 32347 to arrive no later than 4:00 PM, local time, on May 4, 2018 . All bids MUST have name and mailing address clearly shown on the outside of the envelope or package when submitted. Bids will be opened and respondents announced at 6:00 PM local time, or as soon thereafter as practical, on May 7, 2018 at the Taylor County Administrative Complex, 201 East Green Street, Perry, Florida 32348.
    The County reserves the right, in its sole absolute discretion, to reject any or all bids, to cancel or withdraw this bid at any time waive any irregularities in the bid process. The County reserves the right to award any contract(s) to the bidder/respondent which it deems to offer the best overall service, therefore, the County is not bound to award any contract(s) based on the quoted price. The County, in its sole and absolute discretion, also reserves the right to waive minor defects in the process and to accept the bid deemed to be in the County’s best interest. No faxed bids will be accepted.
    All bidders must make an appointment with the Airport Manager, Ward Ketring, to view the 36.5 acres of mature planted pines and approximately 58 acres of non-mature pines and miscellaneous timber. Appointments may be made from April 9, 2018 to April 13, 2018. Access to view planted pines and timber are by appointment only Monday thru Friday from 8:00 A.M. to 5:00 P.M. All awards and/or contracts are subject to the approval of the Federal Aviation Administration (FAA) and the Florida Department of Transportation (FDOT) Aviation Division.

    All other creditors of the decedent and other persons having claims or demands against the decedent’s estate, including unmatured, contingent or unliquidated claims, must file their claims with this court WITHIN 3 MONTHS AFTER THE DATE OF THE FIRST PUBLICATION OF THIS NOTICE. ALL CLAIMS NOT SO FILED WITHIN THE TIME PERIODS SET FORTH IN SECTION 733.702 OF THE FLORIDA PROBATE CODE WILL BE FOREVER BARRED. NOTWITHSTANDING THE TIME PERIODS SET FORTH ABOVE, ANY CLAIM FILED TWO (2) YEARS OR MORE AFTER THE DECEDENT’S DATE OF DEATH IS BARRED.
