    City of Perry Code Enforcement Hearing Magistrate
    The City Council of Perry is soliciting applications for a HEARING OFFICER (Magistrate) FOR CODE ENFORCEMENT CASES FOR THE CITY OF PERRY.
    Qualified firms or individuals desiring to provide the required services must submit their qualifications to City of Perry Code Enforcement Hearing Officer, 224 S. Jefferson Street Perry, Florida 32347, or via email to HYPERLINK “mailto:citycares@cityofperry.net” citycares@cityofperry.net.  The hearing officer is hired on a contractual basis by the City Council and is not a City employee.  Any retainer and hourly rate will be negotiated.  The City Council will consider applications and take whatever action it determines appropriate at advertised and public meetings beginning on September 24, 2013.
    Each applicant must be an Florida licensed Attorney at Law, be a member in good standing with the Florida Bar, have a working knowledge of civil law and be able to make decisions of the enforcement of the City of Perry Code of Ordinances, have a working knowledge of Due Process and be a person willing to listen to all sides of an issue and give a well reasonable written decision.  Code Enforcement hearings are typically held the first Monday evening of each month.
    The City reserves the right, in its sole and absolute discretion, to reject any or all applications, to cancel or withdraw this solicitation at any time and waive any irregularities in the process.  The City also reserves the right to accept the application deemed to be in the Cityís best interest by the City Council.

    DEPARTMENT OF ENVIRONMENTAL PROTECTION
    NOTICE OF DRAFT PERMIT AND NOTICE OF PROPOSED AGENCY ACTION
    The Department of Environmental Protection (Department) gives notice of its preparation of an NPDES draft permit, administrative order, fact sheet, and Level II Water Quality Based Effluent Limit (WQBEL), and establishment of the Level II WQBEL, pursuant to paragraph 62-302.531(2)(a)1.d., Florida Administrative Code (F.A.C.), as site specific numeric interpretations of the narrative nutrient criterion that will supersede otherwise applicable numeric nutrient criteria.  The Department is also announcing a public meeting to receive public comment on the permit application of Buckeye Florida, L.P. – Perry, Florida and the establishment of the Level II WQBEL as site specific numeric nutrient interpretations of the narrative nutrient criterion. The permit and compliance order will require Buckeye to implement upgrades to the paper mill manufacturing process, modify the existing wastewater treatment system, and relocate their discharge outfall.  These steps collectively will enable Buckeye to meet applicable Class III marine water quality criteria for the discharge to the Lower Fenholloway River.  This permit authorizes a new outfall location into the marine portion of the Lower Fenholloway River that is more suitable for the salinity of the discharge.  The draft permit and administrative order authorize the permittee to operate at One Buckeye Drive, Perry, Florida an existing 58 million gallon per day (design) industrial wastewater treatment system discharging at the current location (Outfall D-001), and to construct improvements, including modifications to the existing wastewater treatment system along with an approximate 15 mile treated wastewater pipeline with an outfall/diffuser structure discharging treated effluent to the Lower Fenholloway River estuary through Outfall D-002.  The new permitted discharge, D-002, to the Lower Fenholloway River estuary, Class III Marine Waters (WBID# 3473A), will be located at approximately mile point 1.5 upstream of the River mouth approximately at latitude 2959′ 44″ N, longitude 8346′ 40″ W, in Taylor County, Florida.  The outfall includes a diffuser port that is approximately 100 feet in length and discharges at a depth of approximately 8 feet (Mean Sea Level).
    The applicant, as part of a water quality analysis, published a Notice of Proposed Water Quality Study, and conducted an approved Plan of Study to establish appropriate WQBELs associated with the proposed relocation of the discharge outfall. The applicant completed data collection and analysis and submitted a final technical report. The Department has approved the final technical report under the WQBEL Level II Process in accordance with Chapter 62-650, F.A.C., which is a means of determining the available assimilative capacity of the waterbody and establishing WQBELs for dissolved oxygen, total ammonia, nutrients (total nitrogen (TN) and total phosphorus (TP)) and transparency.  This WQBEL is being proposed for public comment along with this Notice of Draft Permit.
    The portion of the Level II WQBEL setting forth the total TN (5,573 lbs/day expressed as an annual average) and TP (839 lbs/day expressed as an annual average) loads from all sources to the Lower Fenholloway River estuary (WBID 3473A) will constitute site specific numeric interpretations of the narrative nutrient criterion set forth in paragraph 62-302.530(47)(b), F.A.C., that will supersede otherwise applicable numeric nutrient criteria for this particular surface water segment.  No other portion of the WQBEL will act as a site specific numeric interpretation of the narrative nutrient criterion.  The portion of the total allowable nutrient loading assigned to the applicant is a wasteload allocation of 2,698 lbs/day TN and 600 lbs/day for TP.
    Any interested person may submit written comments on the Department’s proposed permitting decision to Jeff Martin, P.E., 8800 Baymeadows Way West, Suite 100, Jacksonville, Florida 32256-7577 an email sent to Buckeye_Comments@ dep.state.fl.us in accordance with Rule 62-620.555, F.A.C.  The comments must contain the information set forth below and must be received in the Department’s Northeast District Office by the close of business on Tuesday October 22, 2013.  Failure to submit comments within this time period may constitute a waiver of any right such person may have to submit comments under Rule 62-620.555, F.A.C.
    The comments must contain the following information:
    (a) The commenter’s name, address, and telephone number; the applicant’s name and address; the Department permit file number; and the county in which the project is proposed;
    (b) A statement of how and when notice of the Department’s action or proposed action was received;
    (c) A statement of the facts the Department should consider in making the  final decision; and
    (d) A statement of which rules or statutes require reversal or modification of the Department’s action or proposed action.
    Through October 22, 2013, the Department will also accept written comments on the establishment of the Level II WQBEL for TN and TP as site specific interpretations of the narrative nutrient criterion.  Written comments should be directed to Jeff Martin at the address above.
