The above cause coming on to be heard upon the Complaint filed herein by the City of Perry, Florida (referred to herein as the “Plaintiff”) seeking to determine the authority of the Plaintiff to issue its not to exceed $2,926,000 City of Perry, Florida Water and Sewer System Revenue Bonds (the “Bonds”), and its not to exceed $2,926,000 City of Perry, Florida Water and Sewer System Bond Anticipation Notes (the “Bond Anticipation Notes), a more particular description of such obligations being contained in the Complaint filed in these proceedings, to determine the legality of the proceeedings has and taken in connection therewith, and the legality of the provisions, covenants and agreements contained therein and the revenues pledged to the payment thereof, and seeking a judgment of this Court to validate the proceedings for said Bonds and Bond Anticipation Notes, the revenues pledged for the payment thereof, and said obligations when issued pursuant thereto, and said Complaint now having been presented to this Court, for entry of an Order to Show Cause pursuant to Chapter 75, Florida Statutes, and the Court being fully advised in the premises:
IT IS ORDERED AND ADJUDGED that the State of Florida, through the State Attorney of the Third Judicial Circuit of Florida, and the several taxpayers, property owners and citizens of the Plaintiff, including non-residents owning property or subject to taxation therein, and all others having or claiming any right, titles interest in property to be affected in any way thereby, or to be affected thereby, be and they are each hereby required to show cause, if any there be, before this Court on September 18, 2014 at 11:30 a.m. in the Taylor County Courthouse, Grand Jury Room, Perry, Florida, why the prayer of said Complaint should not be granted and why the proceedings for said Bonds and Bond Anticipation Notes and said Bond and Bond Anticipation Noted when issued pursuant thereto and the revenues pledged to the payment thereof should not be validated and confirmed as therein prayed.
